Welcome to Pretzel®, the app for people who want to talk and travel like a local and help others do the same. We hope you enjoy using our mobile application called "Pretzel" (the "App") and the related website (located at www.pretzelapp.com), collectively referred to as the "Service".
Throughout this document, we may refer to ourselves as "Pretzel", "we", or "our". This specifically refers to Pretzel, Inc., the company that runs Pretzel, which is located at 109 E. 19th St, #3B, New York, NY 10003.
We may refer to you as "you", "your", or other forms of the word "you".
Our services require you to provide us with Personal Data. If you choose to withhold any Personal Data requested by us, it may not be possible for you to gain access to parts of the Service and for us to respond to your query. We, as Controllers, use the information we collect to operate and maintain our Service; analyze and improve the user experience; track errors and bugs that occur during your use of the Service in order to improve the Service’s performance and provide accurate, personalized assistance; respond to your questions and concerns; and send you marketing communications.

If you login to the Service through the third party services listed above (Facebook, LinkedIn, or Google Plus) (collectively, the "Social Media Services"), you agree to let Pretzel collect and store certain information collected from your profile associated with the relevant Social Media Service.
By using the Service, you are allowing us to collect and store precise information about your location. We may also collect your approximate location from your IP address. By connecting with another user through the Service, you are allowing us to share your country, state, city, and/or county with that user (we will not, however, share more precise location information without obtaining your prior consent).
When you access our Service, we may automatically collect non-Personal Data information from you (such as, for example, IP host address, web pages viewed, browser type, operating system, referring service, search information, device type, page views, usage and browsing habits on the Service and similar data). Non- Personal Data or aggregate information may be used by us for any purposes permitted by law and may be shared with any number of parties, provided that such information shall not specifically identify you.
If you delete your cookies, change browsers or use a different cookie, our cookie (or an opt-out cookie) may no longer work and you will have to reinput (or opt-out) again.
We may collect information about your device, including your IP address, operating system and browser type, for system administration and in order to create reports. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual by name, but only by anonymous user ID.
Cookies contain information that is transferred to your device. These Cookies are used to store information, such as the time that the current visit occurred, whether the visitor has used the Service before and what site referred the visitor to the Service.
The Analytics Services for our Service collect information anonymously. They report website trends without identifying individual visitors. This "automatically collected" information may include Internet Protocol address ("IP Address"); a unique user ID; device type; device identifiers; browser types and language; referring and exit pages; platform type; version of software installed; system type; the content and pages that you access on the Service; the number of clicks; the amount of time spent on each section; the dates and times that you visit the Service; any problems with the Service encountered by your device, including without limitation bugs, freezes, or crashes; your location; and other similar information. Pretzel shall investigate and report data breaches within 72 hours of becoming aware of such breach. When a breach of Personal Data is likely to result in a high risk to the rights and freedoms of individuals then Pretzel, as Controller, will notify the affected individuals without undue delay.
You should be aware that Personal Data which you voluntarily include and transmit online on the Service or in a publicly accessible blog, chat room, social media platform or otherwise online, or that you share in an open forum such as an in-person panel or survey, may be viewed and used by others without any restrictions. We are unable to control such uses of your Personal Data, and by using the Service or any other online services you assume the risk that the Personal Data provided by you may be viewed and used by third parties for any number of purposes.
We generally do not collect Personal Data from children under the age of 13. If at any time in the future we plan to collect Personal Data from children under 13, such collection and use, to the extent applicable, shall, when required, be done in compliance with the Children’s Online Privacy Protection Act ("COPPA") and appropriate consent from the child’s parent or guardian will be sought where required by COPPA. When we become aware that Personal Data from a child under 13 has been collected without such child’s parent or guardian’s consent, we will use all reasonable efforts to delete such information from our database.
As a convenience to you, we may provide links to third-party Services from within our Service. We are not responsible for the privacy practices or content of these third-party sites. When you link away from our Service, you do so at your own risk.
If you believe the data Pretzel has collected on you is incorrect, you are encouraged to contact us to update it. Any data that is no longer needed for the purposes specified in this Policy will be deleted. You may request to have your data updated or deleted at any point by emailing us at [email protected].
By using the Service, you expressly consent to receive in-product communications from us (including, without limitation, push notifications on the App).
Any phone calls and/or text messages delivered to your phone or device may cause you to incur extra data, text messaging, or other charges from your wireless carrier. MESSAGE AND DATA RATES MAY APPLY. You are solely responsible for any carrier charges incurred as a result of phone and/or text communications from Pretzel.
You have the right to request access to the data or information we have stored on you. You can do this by contacting us at [email protected] We will make sure to provide you with a copy of the saved data particular to you. In order to comply with your request, we may ask you to verify your identity. We will fulfill your request by sending an electronic copy.
If you are using our Services from outside the United States, please be aware that you are sending information (including Personal Data) to the United States where our servers are located. Pretzel may transfer information that we collect about you, including personal information, to affiliate entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from United States law, please note that we will not transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.
Pretzel complies with the EU Data Protection Directive 95/46/EC framework as set forth by the European Union regarding the collection, use, and retention of personal data from European Union member countries and Switzerland. Pretzel has certified that it adheres to the requirements of notice, choice, onward transfer, security, data integrity, access and enforcement.
